Bankruptcy Is Your Legal Right

Did you know that you have bankruptcy rights?  You have a legal right to request bankruptcy relief.  When our founding fathers drafted the United States Constitution, they knew that bad things happen to good people.  They knew that even though you are a good person you may get into a situation where you need to wipe the slate clean and get a fresh start.

Bankruptcy Is Your Constitutional Right

Our founding fathers gave vision to our country.  They foresaw that people would need debt help and that's precisely why when they drafted the Constitution they decided that bankruptcy is your legal right.

United States Constitution

Article 1, Section 8, Clause 4 of the United States Constitution authorizes Congress to enact "Uniform Laws on the subject of Bankruptcies throughout the United States.” It provides that Congress shall enact bankruptcy laws to allow Americans to exercise their bankruptcy rights.  So bankruptcy is your constitutional right.

Federal Bankruptcy Laws

Since the drafting of the Constitution, Congress has enacted federal bankruptcy laws to help protect you.

Most notably, in 1978, Congress adopted the Bankruptcy Reform Act of 1978, codified in Title 11 of the United States Code, commonly referred to as the Bankruptcy Code.

The Bankruptcy Code has been amended several times since 1978, most recently in 2005 through the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 or the BAPCPA.
